Q: Dina, can you start to advertise my property before it is posted in the MLS?

A: NAR's Clear Cooperation Policy requires me to submit the listing to the MLS within 1 business day of public marketing. This means that I cannot place a yard sign, distribute flyers, or post anything online prior to 1 business day of the listing's appearance in the MLS.

This policy was designed to ensure that MLSs are efficient, transparent, pro-competitive, and pro-consumer.

When inventory is low, some agents may attempt to market a property to a limited scope of people, giving certain buyers an advantage. This practice leads to unfair and unequal opportunity, and could be perceived as a violation of Fair Housing regulations.
